Copyright & intellectual property
Hey, It’s You! is operated by BluNET Holding Company, LLC. This page explains who owns what, and what to do if you think something on Hey, It’s You! infringes your copyright.
What we own
The website, the apps and their design, text and artwork belong to BluNET Holding Company, LLC. You may not copy, change or use them without our written permission, except to link to us or to talk about Hey, It’s You!.
Hey, It’s You!, Hey, It’s You! (again) and the Hey, It’s You! logo are unregistered trademarks of BluNET Holding Company, LLC. Please don’t use them in a way that suggests we made, sponsor or endorse something we didn’t.
What you own
Your photos, messages and the rest of what you add stay yours. As the Terms of Use say, you give us only the limited permission we need to store, process, show and deliver them so the features you choose work. Only add what you have the right to use.
Reporting copyright infringement
If you believe something on Hey, It’s You! infringes your copyright, send a written notice to our designated agent (below) with:
- your physical or electronic signature, or that of the person acting for you;
- the copyrighted work you believe was infringed;
- the material you believe infringes it, and enough to find it (for example, the member’s profile ID shown on their profile);
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use isn’t authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them.
When we get a complete notice, we remove the material or block access to it promptly, and tell the member who added it, with a copy of the notice, so they can send a counter-notice. If a notice is missing something, we tell you what. Sending a notice you know is false can make you liable for damages.
Counter-notice
If your material was removed and you believe that was a mistake or that you have the right to use it, you can send our designated agent a counter-notice with:
- your physical or electronic signature;
- the material that was removed and where it was before;
- a statement, under penalty of perjury, that you believe in good faith that it was removed by mistake or misidentification;
- your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the US, any district where we may be found), and that you’ll accept service of process from the person who sent the original notice.
Within 5 business days, we send a copy of your counter-notice to the person who reported the material and tell them we’ll restore it in 10 business days. Unless they tell us within 14 business days of receiving it that they’ve filed a court action to stop the infringement, we put the material back within 10 to 14 business days.
Repeat infringers
We close the account of a member who repeatedly infringes others’ copyrights. A member who gets three valid notices within 12 months, not withdrawn and not overturned by a counter-notice, is removed and isn’t allowed to open a new account. A single notice can be enough when the infringement is deliberate and serious.
